Agreement and Acceptance

These terms and conditions govern the agreement between the client and First Choice Plumbing (hereinafter referred to as "the Company") in relation to the supply of plumbing services, related works, goods, fittings, fixtures, plant, equipment, and associated materials.

A client may engage us by

  • Requesting a quote, booking, inspection, or service call
  • Accepting a quote verbally or in writing
  • Paying a deposit or invoice
  • Instructing us to proceed with work

Unless otherwise stated, quotations remain open for acceptance for 30 days from the date of issue. By accepting a quote, booking our services, or directing us to proceed, the client confirms they have read, understood, and accepted these terms and conditions.

02

Scope of Services & Variations

We provide services including but not limited to emergency plumbing, blocked drains, hot water services, general plumbing repairs, leak detection, residential plumbing, commercial plumbing, strata plumbing, and associated supply and installation works.

Quoted Price Scope: The quoted price covers only the specific work described in the written quote or work order.

Variations: Additional work, changed site conditions, or scope modifications will be quoted separately and must be approved before proceeding.

Additional charges may also apply where

  • Different goods, parts, or fittings are required
  • Hidden, unsafe, or inaccessible site conditions are discovered
  • Third-party works are incomplete or defective
  • Supplier availability or material costs change outside our control

We reserve the right to decline, postpone, or suspend work where safety, access, compliance, or payment concerns arise.

03

Client Responsibilities & Site Access

Access: The client must ensure clear, safe, practical, and unobstructed access to the work area and equipment. Obstructions, unsafe conditions, or the need to move obstacles may result in extra labour or equipment charges.

Approvals & Hazards: The client is responsible for obtaining all necessary owner, strata, or authority approvals and informing us prior to commencement of any known site hazards (hazardous materials, electrical or gas risks, contamination, structural issues, confined spaces).

Concealed Services: The client must clearly identify and communicate the location of underground or concealed services, cables, and pipes prior to any excavation or drilling. If third-party detection is needed, it may be treated as an additional service.

Occupants & Pets: Children, pets, and occupants must be kept safely managed while we attend the premises.

04

Goods, Materials and Title

Ownership of Title: All materials, goods, fittings, fixtures, plant, and equipment supplied remain the absolute property of the Company until all monies owing for those materials and associated services have been paid in full.

Special Orders: Special-order, custom, or made-to-order items are generally non-refundable if the client cancels after ordering, except where required by law.

Existing Systems: Where new equipment or products are connected to existing plumbing, gas, or electrical infrastructure, we take no responsibility for faults, failures, or pre-existing defects in the existing system unless separately engaged to rectify them.

Until ownership passes, the client holds goods as bailee only and must not sell or encumber them. The Company reserves the right to enter premises to recover goods following payment default.

05

Payment Terms & Methods

50% Deposit Required: A 50% deposit is required for every job upon acceptance before work will commence. Work will not begin until the deposit has been received.

Final Balance: The remaining 50% balance is strictly due upon completion of the job.

Payment Methods: We accept payment via Bank Transfer or EFTPOS. Payment details are provided on the invoice.

Compliance Certificates: If a compliance certificate is required, it will be issued upon receipt of final payment in full.

Overdue Payments: Overdue payments may result in suspended work, interest charges of 1% per month (calculated daily), and recovery of reasonable legal and debt collection costs.

06

Cancellation & Refund Policy

Cancellation Notice: Cancellations must be made at least 24 hours in advance.

Non-Refundable Deposits: Deposits may be non-refundable if materials have already been purchased or work has already begun.

Change of Mind: We do not provide refunds or replacements for change of mind or client cancellation after ordering, except where required by law.

07

Workmanship & Product Warranties

Workmanship Warranty: Installation services carry a 3-month workmanship warranty. Maintenance and repair services carry a 28-day workmanship warranty.

Warranty coverage does not cover

  • Issues caused by client misuse, neglect, or lack of maintenance
  • External factors such as tree roots, ground movement, or secondary blockages outside our scope
  • Existing materials reused at the client's request or customer-supplied goods
  • Pre-existing defects or failures in systems not installed or worked on by us
  • Works modified, tampered with, damaged, or relocated by third parties

Manufacturer Warranties: Supplied products carry manufacturer warranties. Diagnostic, removal, or reinstallation labour for faulty manufacturer items remains payable by the client unless covered by the manufacturer.

08

Specific Terms: Hot Water System (HWS) Installations

The following specific terms apply to all hot water system installations, in addition to the general terms above.

Scope of Installation

Installation is based on a standard like-for-like replacement at the existing location with standard connections. Any relocation, structural changes, or upgrades to gas, electrical, or plumbing lines will incur additional charges.

System Supply

The hot water system may be supplied by the Company or provided by the client. If supplied by the client, the Company takes no responsibility for warranty, compatibility, or performance.

Electrical and Gas Work

Any required electrical or gas work must be carried out by a licensed contractor. Where not included, subcontractors can be arranged at additional cost.

Site Conditions

Clear access to the installation area must be ensured. Obstructions, unsafe conditions, or the need to move obstacles may result in extra charges.

Old Unit Disposal

Removal and disposal of the old hot water system is included unless otherwise stated. Units containing asbestos or hazardous materials may incur separate handling fees.

Limitations

We are not responsible for existing plumbing, gas, or electrical faults or compliance issues unrelated to the new installation. Any required rectification work will be quoted separately.

09

Limitation of Liability & Indemnity

To the maximum extent permitted by law, we take care to perform work to a high standard, but we are not liable for pre-existing damage, hidden corrosion, or unforeseen complications beyond our control.

We are not liable for indirect, consequential, or punitive losses, nor damage caused by inaccurately identified underground services or supplier delays. Where liability cannot be excluded, liability is limited at our option to re-performing the service, repairing or replacing goods, or paying the cost of doing so.

The client indemnifies the Company against all claims, losses, costs, and liabilities arising from incorrect information supplied, unsafe site conditions, or breach of these terms.

10

Compliance & Governing Law

Standards: Works are carried out in accordance with applicable laws, codes, and standards relevant to the services engaged. Timeframes given are estimates only.

Governing Law: These terms are governed by the laws of the Australian Capital Territory (ACT) and New South Wales (NSW). The parties submit to the non-exclusive jurisdiction of the courts of the ACT and NSW.
